This section of the rule, which was added to the proposed rule, describes the information the employer must provide in a compliance record. Under the proposed rule, the record was to include a list of all records received by the employer for the incident, including requests for information by OSHA and other federal agencies, and lists of OSHA violations taken as a result of the incident. The final rule does not require the submission of all requests for information by federal agencies and does not require that the employer submit a list of OSHA violations for a workplace incident. Instead, this information is now required to be submitted as part of the occupational injury and illness record that the employer submits to OSHA.

The final rule also includes several revisions to the recordkeeping provisions of the Occupational Safety and Health Administration’s (OSHA’s) Hazardous Materials Management (HMM) regulations. OSHA has consolidated several formerly separate recordkeeping requirements in two separate sections, 1904.32 and 1904.32. OSHA has retained the recordkeeping requirements that are currently in section 1904.32 of the final rule. The recordkeeping requirements that are part of the Hazardous Materials Management part of OSHA’s HMM regulations are found in Part 1904 of the final rule and are discussed in more detail below. OSHA has made no changes to the recordkeeping requirements that are currently in section 1904.32 of the final rule. However, the new section 1904.37 of the final rule includes a clarification that the standards and recordkeeping requirements that are applicable to the Hazardous Materials Management Regulations apply when a covered employer registers for HMM training.

In the final rule, the treatment provided shall be listed as first aid treatment only if it is one of the following: (1) For a minor cut, abrasion, or other superficial wound, the action taken to stop the bleeding, to clean or remove the foreign material, and to apply a clean dressing. (2) For a minor fracture, dislocation, or other condition resulting from exertion, the action taken to stop the bleeding. (3) For medical treatment including hospitalization, the action taken to stabilize or reduce the effects of a medical condition.
Summary of the rule: (a) The employer has the option of whether or not to include first aid treatments in the construction industry recordkeeping system. (b) In deciding whether to include first aid treatments in the recordkeeping system, the employer must consider the following: (1) Whether the treatment is intended to treat a condition or condition arising from an exposure incident. (2) Whether the treatment is intended to treat an illness, injury, or condition arising from an exposure incident and not resulting from an exposure incident. (3) Whether the treatment is intended to treat an illness, injury, or condition arising from an exposure incident and resulting from an exposure incident. (4) Whether the treatment is intended to treat an illness, injury, or condition arising from an exposure incident and not resulting from an exposure incident. (5) Whether the treatment is intended to treat an illness, injury, or condition arising from an exposure incident and resulting from an exposure incident. (c) First aid treatments for exposure incidents that are not work-related are not included in the construction industry recordkeeping system. (3) Treatment by or under the supervision of a licensed practitioner of the healing arts as defined by section 301 of the act. (f) The final rule retains the current authority of employers to establish additional first aid treatments that are not included in the list of first aid treatments.
